ZesToraAgreement to Terms
By installing and using any ZesToraX application ("App") or visiting our website, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our services.
Description of Service
ZesToraX provides a family of focused Shopify applications, each designed to solve one specific merchant problem — including profit analytics (ProfitGuard Pro), dead stock and stockout management (ShelfClear, RestockClear), loyalty rewards (RewardClear), and order tracking (ShipClear).
Eligibility
To use our Apps, you must:
- Be at least 18 years old
- Have a valid Shopify store
- Have the authority to accept these Terms on behalf of your business
Account and Access
Our Apps are accessed through your Shopify admin. You are responsible for:
- Maintaining the security of your Shopify account
- All activities that occur under your account
- Ensuring your account information is accurate and current
Subscription and Billing
Free Trial
We offer a free trial period for new users. During the trial, you have access to app features as specified. No payment is required during the trial period.
Paid Subscriptions
After the trial period, continued use requires a paid subscription. Billing is handled through Shopify's billing system. By subscribing, you authorize Shopify to charge the applicable fees to your account.
Refunds
Refunds are considered on a case-by-case basis. If you believe you were charged in error or are unsatisfied with your subscription, contact us at support@zestorax.com and we'll work with you — but a refund is not guaranteed.
Cancellation
You may cancel your subscription at any time by uninstalling the App from your Shopify store. You will retain access until the end of your current billing period.
Acceptable Use
You agree not to:
- Use our Apps for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App or servers
- Circumvent any security features
- Use automated systems to access the App without permission
- Resell or redistribute the App without authorization
Intellectual Property
The App, including all content, features, and functionality, is owned by ZesToraX and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
Data and Privacy
Your use of our Apps is also governed by our Privacy Policy. By using our Apps, you consent to the collection and use of data as described in our Privacy Policy.
Disclaimer of Warranties
Our Apps are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Accuracy or completeness of any information
- Uninterrupted or error-free operation
We do not guarantee that the App will meet your specific requirements or that any errors will be corrected.
Limitation of Liability
To the maximum extent permitted by law, ZesToraX shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Any damages arising from your use or inability to use the App
Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless ZesToraX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
Modifications to Service
We reserve the right to modify, suspend, or discontinue the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.
Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Bangalore, Karnataka, India.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
